Judiciary must utilize the
situation to admit corruption in the system. There are ample cases not only in
higher echelons but in lower courts also. Corruption is not confined to
monetary or influence but in regressive value system. In a democratic system it
is shocking that there is no transparency in selection process to higher courts.
Use of feudal and colonial references and attire is a serious breach, and
severely degrades egalitarian values. Most lawyers are unruly and use devious tactics
to delay rather than seek justice, many are charlatans that common people have
to deal on daily basis. There are also ‘celebrity’ lawyers (like Sibal or Singhvi)
who charge astronomical amount. What is the basis of these kind of ridiculous fees?
Why are these earnings not questioned or curtailed? It is clearly a case of corruption
which creates two tiers -meaning if you give more money the system will work its
influence, otherwise why would anyone pay that amount of money? This is an open blatant corruption. Further, many of these ‘celebrity’ lawyers use their influence to
gain political clout (clearly, they use information gained by representing mostly
corrupt politicians and officials to extract influence). Some have even become ministers
and crept into RS, a clear indication of systemic corruption. So have many
judges quit to join politics or taken up cushy positions immediately after
retirement while lawyers are in constant lookout for cozy deals as they 'fight' cases. Argument that
most ‘freedom fighters’ were lawyers doesn’t hold good since context was
different, as also, they were negotiating and not fighting against the system (that violence was delegated
to common people), the reason why corruption is systemic. There is a reason why
judiciary sometimes reflects (even after 75yrs) the colonial feudal intentions
than reality of India. And when they try to connect, they pontify with most
regressive ‘advice’ and small talks, as if some kind of benign wise ‘trustees’ of common
people. Lack of empathy and characteristic arrogance percolates from higher echelons
of judiciary onto lawyers. It is like the sanctum where superior attributes accrued to god while squatter cleverly playing the benign receiver hence all the attributes!
Indian judiciary is tardiest, with delays that extends to decades, and many -mostly poor and marginalized, languish in jails for years as undertrials. In the midst of lackadaisical system and horrifying delays judiciary spent more time in holidays consuming precious state money and public time. Judiciary is as corrupt and tardy as any other institution in India. Children must be taught the truth that there is corruption in judiciary otherwise education is being curtailed. 'Perturbed' judges are least of concern for common people. If government withholds school book that teaches truth of the matter, then that means judiciary has used its nefarious influence as threat to curtail freedom of expression. 14years old children are being denied right to knowledge by Indian judiciary.
